What Is a Mandatory HMO Licence?

A mandatory HMO licence is a legal requirement under the Housing Act 2004, as amended by the Licensing of Houses in Multiple Occupation (Mandatory Conditions of Licences) (England) Regulations 2018.

Since October 2018, the previous 3-storey requirement was removed. Now, any property rented to 5 or more people from 2 or more separate households must be licensed — regardless of how many floors it has.

This applies throughout England and Wales, including all London boroughs.

Who Needs a Mandatory HMO Licence?

You MUST apply if your property is:

  • Rented to 5 or more people
  • Occupied by people from 2 or more separate households
  • Used as their only or main residence
  • Has shared kitchen, bathroom or toilet facilities

A ‘household’ typically means a single person or members of the same family. So a 5-bedroom property with 5 unrelated tenants requires a mandatory HMO licence.

Any landlord who rents a property to 5 or more people forming 2 or more separate households, who share facilities such as a bathroom or kitchen. This applies regardless of the number of storeys since October 2018.

The licence covers the property's management, physical standards (room sizes, amenities), fire safety measures and the fit and proper person test for the landlord or managing agent.

Mandatory HMO licences are issued for up to 5 years. You must apply to renew before expiry — we can handle renewals too.

Minimum room sizes apply: single sleeping rooms must be at least 6.51m², double rooms at least 10.22m², and rooms for children under 10 at least 4.64m². Rooms below these minimums cannot be used as sleeping accommodation.
